Funeral wishes

Please give an outline of the wishes you have, indicating whether you want to be buried or cremated. If you have a preferred burial site or location at which ashes are to be scattered, state this and give any burial plot number.

It is not advisable to rely on your Will as the sole or main method of making known to your Executors and relations what your wishes are in this respect, because the Will may not be read until after your funeral. We would therefore advise you to communicate your wishes orally to your relations and embody them in written directions separate from your Will. These directions may, for example, be enclosed in an envelope addressed to your nearest relation and directed to be opened immediately after your death.

Detailed wishes regarding music or readings at your funeral service should also be dealt with in a letter accompanying your Will.

Executors

These are the people who will carry out the wishes you express in your Will. You can choose individuals (ideally at least two), this firm, your accountant or bank, or the Public Trustee. A charity you wish to support may be able to act as Executor too. You should speak to the proposed Executor(s) before completing this Questionnaire, as professional charges will vary.

Please note that a legacy to an Executor is presumed to be conditional on them so acting, unless the Will provides otherwise.

Cash gifts (called "Pecuniary Legacies")

Please give details of any gifts you want to make of set sums of money to individuals, or to charities you want to support. If you are supporting a charity could you please provide us with one of its publications (or telephone number), so we can check its correct name and address and charity registration number.

Although such gifts are not technically payable until one year after death, interim payments are normally made before this date.

Gifts of your possessions

a. "Specific legacies"

Please list particular property you want to give to certain individuals, giving as clear a description as possible. You should also state if the property is subject to any charge or mortgage and, if so, whether it is to be given free of the charge/mortgage.

Please note that if you no longer possess the property at your death, the gift will fail and the recipient will not be entitled to any property which you may have acquired in substitution for that mentioned in your Will.

b. "Reversionary Legacies"

These are gifts where you want someone to have the benefit of something you own (such as your house) for the rest of their life, after which someone else (or a charity) is to have the item.

Please note that cash gifts and gifts of your possessions will, unless the Will is expressed to the contrary, take effect free of tax.


"Residuary Legacies"

What do you want to happen to everything else that you own? This is called "residue" and gifts of residue are called "residuary legacies". The value of whatever else you own is arrived at after your funeral costs, taxes and expenses have been paid, and after the gifts of money and possessions have been made. When deciding who should have what is left, think in terms of percentages, making sure that the shares you give add up to 100%! A share of residue may well be more valuable to the person you give it to than a gift of a fixed amount of money, since it will not be eroded by inflation
