ENDURING POWERS OF ATTORNEY
A Power of Attorney is a document in which one person (the donor) gives another person (the donee) authority to act on his or her behalf and in his or her name. An Ordinary Power of Attorney is cancelled if the donor becomes mentally incapable. An Enduring Power (EPA), however, remains in force despite the donor’s mental incapacity, provided that it is registered with the Public Trust Office.
EPAs can be created by anyone, even a minor, and are a sensible precaution against the accidents, illnesses and injuries that can incapacitate a person of any age. The alternative is a lengthy and costly Receivership application to the Court of Protection.
Fixed fees are available for both the preparation and registration of an EPA and can be discounted in certain circumstances.
